Acceptance of Terms
By purchasing or utilizing Redvail’s County GOP Consent Acquisition Program (“the Service”), the client (“County GOP,” “Client,” or “You”) agrees to be bound by these Terms of Service. These terms constitute a legally binding agreement between the Client and Redvail (“Redvail,” “We,” or “Us”). If the Client does not agree to these terms, the Service may not be purchased or used.
Service Overview
Redvail provides consent acquisition outreach, contact processing, and verification infrastructure designed to collect opt-in confirmations from individuals contained within the Client’s existing data sources. Redvail initiates outreach directly and delivers verified, timestamped consent records to the Client upon completion.
Authorized Use of the Service
The Client agrees that the Service will be used solely for lawful political communication and operational purposes. The Client may use the verified opt-in records to contact individuals regarding political updates, volunteer opportunities, fundraising, or educational information related to GOP activities. The Client may not use the Service or resulting data for commercial advertising, resale, or for the benefit of third parties not directly affiliated with the County GOP unless explicitly authorized by Redvail.
Data Submission Requirements
The Client must provide all contact datasets in a lawful manner and represent that any provided list originates from legitimate and non-prohibited sources. The Client is solely responsible for ensuring that all submitted data complies with applicable federal and state laws, including any restrictions regarding voter registration data, donor records, or membership information.
Prohibited Conduct
The Client may not:
Use unverified records for mass outreach
Attempt to circumvent Redvail’s consent process
Upload stolen, misappropriated, or commercially purchased lists
Engage in spam, harassment, or unethical communication practices
Contact individuals prior to receiving verified opt-in status
Redvail reserves the right to immediately suspend or terminate the Service if prohibited conduct is detected.
Redvail as the Originating Sender
All outreach is initiated by Redvail as the originating sender. The Client understands and agrees that this structure is necessary to maintain compliance with political communication norms and applicable regulations. Only individuals who explicitly confirm consent through Redvail’s system may be transferred to the Client for future contact.
No Guarantee of Performance
Redvail does not guarantee any minimum level of engagement, response rate, opt-in volume, deliverability, or specific list performance metrics. The Service is sold strictly as an outreach and processing operation, and results will vary based on list quality, age, data integrity, and other environmental factors.
Data Ownership and Rights
Upon delivery, all verified opt-in records obtained through the Service become the property of the County GOP. Redvail retains ownership of all proprietary tools, processes, form templates, outreach sequences, and operational methodologies used to deliver the Service. Redvail may retain anonymized metadata associated with the Service for auditing, optimization, or performance benchmarking purposes.
Confidentiality and Data Security
Redvail agrees to maintain strict confidentiality regarding all Client data, records, files, opt-ins, and operational details associated with the Service. Redvail will employ reasonable security measures to protect Client data from unauthorized access or disclosure.
Payment and Billing
All fees—both base-rate and per-record processing fees—must be paid as outlined in the cost calculator or agreement. Payments are non-refundable once initial outreach has begun. Failure to complete payment may result in delayed delivery, suspension of the Service, or removal of access.
Service Modifications
Redvail reserves the right to modify, refine, or improve the Service at any time, provided such modifications do not materially reduce the functional value of the Service for the Client. Redvail may also refuse additional list submissions if they exceed the scope of the initial agreement.
Limitation of Liability
Redvail is not liable for:
Damages resulting from inaccurate or outdated Client data
Loss of reputation or goodwill
Email deliverability issues or third-party service failures
Regulatory consequences arising from the Client’s misuse of exported data
The maximum liability of Redvail shall not exceed the total amount paid by the Client for the Service.
Termination
Either party may terminate the agreement for material breach. Redvail may terminate immediately if the Client engages in unlawful data practices, unethical outreach, or prohibited conduct. Upon termination, all outstanding fees remain due.
Governing Law
This agreement is governed by the laws of the state in which Redvail operates. Any disputes arising from this agreement shall be resolved in the appropriate jurisdictional venue determined by Redvail.
Client Agreement
By purchasing, accessing, or engaging with the Service, the Client acknowledges that they have read, understand, and agree to these Terms of Service.
